Every DWI arrest in Louisiana triggers two separate cases. The criminal charge moves through the courts. The license suspension moves through the Louisiana Office of Motor Vehicles under La. R.S. 32:667. We handle both, and we treat the administrative suspension fight as urgent because it is.

Under La. R.S. 32:667, the arresting officer seizes your license on the spot and issues a temporary receipt. That receipt is your notice. You typically have 30 days from the date of arrest to submit a written request for an administrative hearing to the Louisiana Department of Public Safety and Corrections, unless special circumstances exist.
Miss that window, and the suspension begins automatically. In most circumstances, there is no grace period and no second chance to request the hearing once the deadline passes.

You usually have 30 days from the date of your arrest to request the administrative hearing. That deadline is hard, unless you’ve been incarcerated, hospitalized, or another special circumstance exists. Contact us as soon as you have the temporary receipt from the arresting officer so we can file the request before the window closes.
The Division of Administrative Law schedules a hearing within 60 days of receiving the request. An administrative law judge reviews the evidence of the stop and the test or refusal. We attend on your behalf and present every available challenge to the suspension. If the judge rules in your favor, the proposed suspension is lifted. If not, appeal options may be available.
Sometimes. A restricted license for work and essential travel is available for eligible first and second offenses, provided you install an ignition interlock device on your vehicle. Eligibility depends on the nature of the offense and your BAC or refusal record. We evaluate this at the same time as the hearing challenge, so both options are in play simultaneously.
They are separate proceedings with separate deadlines. The criminal DWI case is prosecuted by the 23rd Judicial District Attorney’s Office and is handled in the Ascension Parish courts. The administrative suspension is initiated by the OMV and decided by the Division of Administrative Law. Missing the hearing deadline affects your license regardless of what happens in the criminal case. We handle both.
